🎅 Welcome to Santa's Official Nice List! By using this magical service, you agree to these merry terms and conditions.

1. 🎄 Acceptance of Terms

By submitting a child to Santa's Nice List or using any features of nicelist.net (the "Service"), you agree to these Terms of Service ("Terms"). If you disagree with any part of these terms, please close your browser and enjoy some hot cocoa instead—no hard feelings!

2. 🎁 Eligibility & Use

Who Can Use This Service: Parents, guardians, and responsible adults (18+) may submit children ages 2-16 to Santa's Nice List. You must have proper authority to submit information about a child. Santa trusts you—don't make him check his list twice!

Prohibited Uses: You may not:

• Submit false, misleading, or naughty information
• Use the Service for spam, harassment, or other grinchy behavior
• Attempt to hack, scrape, or otherwise tamper with Santa's systems
• Submit personally identifiable information beyond what's requested
• Use automated bots or scripts (only Santa's elves are allowed to automate things here)
• Impersonate Santa, his elves, or any reindeer

3. ⭐ Content & Moderation

Your Submissions: When you submit a child to the Nice List, you represent that:

• All information provided is truthful and accurate
• You have permission from the child's parent/guardian to make this submission
• The content does not violate any laws, regulations, or third-party rights
• The nice deed description (if provided) is appropriate for all ages

Our Moderation Rights: Santa's elves review all submissions using both automated and manual moderation. We reserve the right to:

• Approve, reject, or flag any submission at our discretion
• Remove content that violates these Terms or community standards
• Ban users who repeatedly violate these Terms
• Modify submissions to correct obvious typos or formatting issues

4. 🔒 Privacy & Data

Your privacy is important to us! Please review our Privacy Policy to understand how we collect, use, and protect your information. Santa takes data protection seriously—after all, he's been managing a naughty and nice database for centuries!

5. 💳 Premium Features & Payments

Basic Service: Submitting a child to the Nice List and receiving a basic certificate is FREE! Because spreading Christmas spirit shouldn't cost a thing.

Premium Upgrades: Optional premium features (certificates, letters from Santa, etc.) are available for purchase. By purchasing premium features:

• All sales are final once your certificate/letter is generated
• Premium features are non-refundable (but we promise they're worth every candy cane!)
• Prices are subject to change, but not for purchases already made
• We use Stripe for secure payment processing

Refund Policy: While all sales are final, if you experience technical issues preventing delivery of your premium content, please contact us at support@nicelist.net and we'll make it right. Santa doesn't want any disappointed children on Christmas morning!

6. 🎅 Intellectual Property

Our Content: The nicelist.net website, design, code, graphics, Santa's route, and all other content (except user submissions) are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, or redistribute our content without permission.

Your Content: You retain ownership of any content you submit. By submitting to our Service, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and promote your submission as part of the Nice List. This helps us spread Christmas cheer!

7. ⚠️ Disclaimers & Limitations

No Guarantees: While we strive for 100% uptime (like Santa's workshop on Christmas Eve), we provide this Service "AS IS" without warranties of any kind, express or implied. We do not guarantee:

• That the Service will be uninterrupted or error-free
• That Santa will actually visit your home (though we hope he does!)
• That being on the Nice List guarantees specific presents
• The accuracy of user-generated content

Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or other issues transmitted through the Service
• Any errors or omissions in content
• Coal in your stocking (that's between you and Santa!)

8. 🎄 Indemnification

You agree to indemnify, defend, and hold harmless nicelist.net, its operators, elves, and reindeer from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit

9. 🌟 Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination:

• Your right to use the Service immediately ceases
• We may remove your submissions from public display
• Previously purchased premium content remains accessible via your unique links

10. 🔄 Changes to Terms

We may modify these Terms at any time. We'll notify users of significant changes by posting a notice on our website or sending an email. Your continued use of the Service after changes constitutes acceptance of the modified Terms. We promise to only update these when necessary—we know reading legal documents isn't as fun as opening presents!

11. ⚖️ Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration (or in Santa's workshop court of law, whichever comes first).

Assignment: You may not assign or transfer these Terms without our consent. We may assign these Terms to any affiliate or successor.
